General Internet Usage Policy
Cport.Com, LLC (Cport.Com) is committed to and supports the free flow of information and ideas over the Internet. Cport.Com does not actively monitor nor does Cport.Com exercise editorial control over the content of any web site, electronic mail transmission, mailing lists, news groups or other material created or accessible over Cport.Com services. However, Cport.Com reserves the right to remove any materials Cport.Com does become aware of that are, in Cport.Coms sole discretion, potentially illegal, could subject Cport.Com to liability, or
Violate this Acceptable Use Policy ("Policy"). Your violating this Policy may result in the suspension or cancellation of your Cport.Com services. You should read and interpret this Policy in conjunction with the Cport.Com Acceptable Use Policy ("AUP") Agreement.
Members Acknowledge the following:
CPORT.COM MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND WITH RESPECT TO THE SERVICES OR THE SOFTWARE, WHETHER EXPRESSED OR IMPLIED, EITHER IN FACT OR BY OPERATION OF LAW. CPORT.COM EXPRESSLY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. CPORT.COM DOES NOT WARRANT THAT THE SERVICES OR SOFTWARE ARE ERROR-FREE OR THAT OPERATION OF THE SERVICES OR SOFTWARE OR INTERNET ACCESS WILL BE SECURE, UNINTERRUPTED OR ERROR-FREE.NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED IN THIS AGREEMENT. NEITHER PARTY SHALL UNDER ANY CIRCUMSTANCES BE LIABLE TO THE OTHER PARTY FOR CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES, INCLUDING LOST PROFITS, EVEN IF SUCH PARTY HAS BEEN APPRISED OF THE LIKELIHOOD OF SUCH DAMAGES OCCURRING. CPORT.COM RESERVES THE RIGHT TO REFUSE OR CANCEL SERVICE TO ANYONE FOR ANY REASON.
Policies:
The following are violations of Cport.Com acceptable use policies:
Using a personal account for high volume or commercial use. If you would like to receive high-volume or commercial services, please contact Cport.Com Business Sales Department at 1-360-414-8585 for information about establishing your own personal domain. Activities which are prohibited as high volume include, but are not limited to:
Any mailbox exceeding 5MB may, at Cport.Com discretion, be transferred to a compressed temporary file or storage. Members will be notified at that time with further information. Thirty days after this notification, Cport.Com reserves the right to delete the temporary file from the server;
Exceeding 1GB of traffic in a one-month period for free Web sites. Any Free Web site exceeding 1GB of traffic will be billed for the excess traffic charges. These charges will be determined according to Cport.Com;
Using Cport.Com services for illegal purposes or in support of illegal activities. In accordance this Internet Access Agreement, Cport.Com reserves the right to cooperate with legal authorities. And/or injured third parties in the investigation of any suspected crime or civil wrong. Activities which are prohibited as potentially illegal includes, but are not limited to:
Unauthorized copying of copyrighted material including, but not limited to, digitization and distribution of photographs from magazines, books, or other copyrighted sources, and copyrighted software;
Exporting software or technical information violation of U. S. exports control laws;
Posting or emailing of scams such as make-money-fast schemes or pyramid/chain letters;
Threatening bodily harm or property damage to individuals or groups;
Making fraudulent offers of products, items, or services originating form your account;
Attempting to access the accounts of others, or attempting to penetrate security measures of Cport.Coms or other entities systems ("hacking"), whether or not the intrusion results in corruption or loss of data;
Harassing others by mail-bombing or 'news-bombing constitutes sending more than ten (10) similar mail messages to the same email address. News bombing constitutes sending more than 10MB of data to a newsgroup;
Sending unsolicited email messages where the recipient objects to the content of the message or to the receipt of the message in general is also prohibited under this section;
Member acknowledges that he/she is expressly prohibited from utilizing Cport.Com Networks services, Cport.Com Network's equipment or any Cport.Com Networks electronic mail address in connection with the sending of the same or substantially similar unsolicited electronic mail message, whether commercial or not, to a large number of recipients. This prohibition extends to the sending of unsolicited mass mailings form another service which in any way implicates the use of Cport.Com Networks equipment or any Cport.Com Networks electronic mail address.
A message is unsolicited if it is posted in violation of a USENET of Newsgroup charter and/or if it is sent to a recipient who has not requested or invited the message. For purposes of this provision, merely making ones email address accessible to the public shall not constitute a request or invitation to receive messages.
Member specifically agrees that he/she will not utilize the Cport.Com Network service Cport.Com Networks equipment or nay Cport.Com Network electronic mail address in connection with the transmission of the same or substantially similar unsolicited message to 50 or more recipients, or 15 or more newsgroups in a single day. For each day upon which this provision is violated, member agrees to pay Cport.Com Network $50.00 per day for an unintentional violation of this provision, but where warranted, such as in the case of and accidental transmission, Cport.Com Network may waive all or part of the applicable charge. In cases of willful violations of this provision, member agrees to pay Cport.Com Network $500.00 per day. Cport.Com, Inc. at its sole discretion shall determine whether such a violation was unintentional or willful. Payment by member under this provision shall not prevent from seeking to obtain other legal remedies against a member, including other damages or an injunction;
Revealing your account password to others or allowing use of your account by others (other than authorized users in your household);
At no time can there be simultaneous use of the same username and password combination;
Forging any message header, in part or whole, of any electronic transmission, originating or passing through Cport.Com services;
Distributing viruses to or form Cport.Com systems;
Use of software or any device that would allow your account to stay logged on while you are not actively using Cport.Com services or use the account for the purpose of operation server of any type;
Cross-posting advertisements for products, items, or services to ten (10) or more unrelated USENET newsgroups;
Posting articles to any USENET newsgroup, mailing list or similar forum, which is off-topic according to the charter or other public statement of the forum;
Disrupting any newsgroup with frivolous, excessively vulgar, or repetitious postings;
Posting of binary, or excessively large, unrelated text files to non-binary new groups that have specifically requested such material not be posted in the groups FAQ (Frequently Asked Questions).
Cport.Com Assumes No Liability:
Cport.Com has no practical ability to restrict all conduct, communications or content which might violate this Policy prior to its transmission on Cport.Coms systems, nor can Cport.Com ensure prompt removal of any such content after transmission or posting. Accordingly, Cport.Com does not assume liability to subscribers or other for any failure to enforce the terms of this Policy.
The service is provided on an "as is" and "as available" basis without warranties of any kind, either expressed or implied, including but not limited to warranties of title, not-infringement or implied warranties of merchantability or fitness for a particular purpose. No advice or information given by Cport.Com, its affiliates, access provider or its contractors or their respective employees shall create a warranty. Neither Cport.Com nor its affiliates or access providers warrants that the service will be uninterrupted or error free or that any information, software, or to the material accessible on the service is free of viruses, worms, Trojan horses or other harmful components.
Cport.Com has a NO REFUND policy. Cport.Com, upon subscription of a new Internet account, makes provision for the subscriber on it's network based on subscription length. However, after receipt of a certified letter, notifying Cport.Com of subscriber's intention to cancel subscription, Cport.Com will transfer any existing balance to another network (Cport.Com or CetNet.Net) user. Cport.Com will not, UNDER ANY CIRCUMSTANCES refund any monies paid for any Internet subscription or overpayment of any Internet subscription. This policy is strictly enforced.
Revisions To This Policy:
Cport.Com reserves the right to modify this Policy at any time. Notice of modifications to this Policy may be given to subscribers by posting such changes to Cport.Com homepage www.cport.com, by electronic email, or by conventional mail.
Cport.Com reserves the right to send it's customers email notifications regarding updates and changes, and occasional marketing or promotional literature.
