CPORT.COM MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND WITH RESPECT TO THE SERVICES OR THE SOFTWARE, WHETHER EXPRESSED OR IMPLIED, EITHER IN FACT OR BY OPERATION OF LAW. CPORT.COM EXPRESSLY DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. CPORT.COM DOES NOT WARRANT THAT THE SERVICES OR SOFTWARE ARE ERROR-FREE OR THAT OPERATION OF THE SERVICES OR SOFTWARE OR INTERNET ACCESS WILL BE SECURE, UNINTERRUPTED OR ERROR-FREE.NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED IN THIS AGREEMENT. NEITHER PARTY SHALL UNDER ANY CIRCUMSTANCES BE LIABLE TO THE OTHER PARTY FOR CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES, INCLUDING LOST PROFITS, EVEN IF SUCH PARTY HAS BEEN APPRISED OF THE LIKELIHOOD OF SUCH DAMAGES OCCURING.
Responsible Usage:
We exercise no control over the content of the information passing through our systems; we
only provide access. You must take responsibility for your actions on our system and the
systems you access through us. You must comply with whatever rules or Acceptable Usage
Policies that are appropriate for the systems you access.
If you are offended by information you find on any system, it is your responsibility to avoid whatever you find offensive. You must take responsibility for the statements you make in e-mail, chat or discussion forums, and Usenet newsgroups.
If you violate any of Cport.Com's usage policies or your actions, whether intentional or unintentional, endanger our systems or another network's systems from another provider, company or individual, Cport.Com may suspend your access at any time, without prior notice.
Cport.Com management is the final and sole judge of whether any abuse or violations have occurred.
Censorship:
Cport.Com has a policy of NO censorship,
either from or to our systems, UNLESS, the information transmitted is illegal or is
clearly used for fraud. The "warez" and "crack" Usenet news groups are
an example of this. We do not censor our newsgroup listings and subscribe to entire
hierarchies as opposed to particular groups. The individual groups within these
hierarchies may contain information or articles that are considered illegal or
pornographic. Cport.Com assumes no liability for the content of the newsgroups that pass
through our servers and it is the customer's obligation to decide what they subscribe to
or view. Please see our Parental Control Software page
for a list of programs to assist you if you need to censor the content of the Internet to
your home.
Account Usage:
Your account is for your exclusive and individual use only; multiple concurrent logins of
the same account are not allowed. Beyond the fact that allowing others to use your account
is prohibited, consider that you become responsible for the charges incurred by someone
else that you have allowed using your account. For this reason you should protect your
account and password as you would any other personal resource such as your telephone or
credit card number.
An individual dial-up account entitles only the named user to log in, and from only one dial-up modem or TCP/IP connection at a time. Multiple individuals accessing a single account is not permitted unless by special arrangement.
Cport.Com also offers dedicated connections and dedicated lines. Those dedicated service accounts are not governed by the above non-dedicated account usage policies, but ARE governed by ALL other AUP terms and GIU conditions. Other uses are considered fraudulent. A charge equal to the monthly service fee may be charged for additional concurrent login sessions within a billing period.
The dial-in package allowing unmetered access is not a substitute for a dedicated line. Unmetered access allows an unmetered amount of time each month to use our service in an interactive mode. We ask that all our users log off if idle for more than 30 minutes. This keeps system load low and improves availability of services to other customers. We reserve the right to automatically disconnect such users from our routers or servers after 10 or more minutes of inactivity.
Cport.Com reserves the right to implement, at its discretion, any utility necessary to provide fair access opportunities for all Cport.Com dial-up customers. As such, if lines become full on a particular day, Cport.Com may automatically disconnect users who have been online for many hours that day. This is meant to free up modem lines for other customers who have had no opportunity to access Cport.Com resources on that day. This utility will result in no additional fee for extended usage. The term "unmetered access" implies only that there is never an hourly surcharge for Cport.Com dialup service. It does not imply a specific guaranteed connection time daily. Users requiring guaranteed access at any or all times of the day should consider a dedicated line.
LOCAL ACCESS DIALUP NUMBERS MAY NOT BE AVAILABLE IN ALL AREAS. IT IS YOUR SOLE RESPONSIBILITY TO DETERMINE IF USE OF A PARTICULAR Cport.Com DIALUP NUMBER WILL CAUSE YOU TO INCUR LONG-DISTANCE, TOLL OR OTHER CHARGES. Cport.Com IS NOT RESPONSIBLE FOR ANY LONG-DISTANCE OR TOLL CHARGES INCURRED BY YOU THROUGH YOUR USE OF THE SERVICE. YOU ARE SOLELY RESPONSIBLE FOR ALL TELECOMMUNICATIONS CHARGES INCLUDING LOCAL AND LONG-DISTANCE TELEPHONE CHARGES FOR CONNECTION TO THE SERVICE BY YOU AND BY THOSE WHO ACCESS THE SERVICE THROUGH YOUR ACCOUNT.
Resource Usage:
No system has unmetered resources and we expect you to act responsibly when consuming
resources on our system. If you consume excessive resources on our system we may suspend
your access at any time without prior notice.
Customers using dial-up analog modem accounts may not run any servers, such as HTTP, FTP or MAIL, IRC, QUAKE or GAME servers. Excessive concurrent processes or processes which continue after you have logged off are prohibited.
Our servers automatically end long idle calls, and during peak times you can expect minimum allowed idle time of at least 10 minutes.
Users that stay connected for more than 4 (four) continuous hours are subject to automatic disconnection. If this should occur while you are still on-line and interactively using the Internet, simply re-dial and login again.
No connection may be used for more than 8 continuous hours - this is called "hanging" and Cport.Com considers this an excessive use of our resources.
While Cport.Com, Inc. provides free technical support that does not necessarily mean that technical support is unmetered and free of charge. Any technical support that is deemed to be excessive in amount or duration will be billed to the customer's account at the rate of $45.00 per hour with a minimum charge of $11.25 (15 minutes). This determination will be made by Cport.Com, LLC based on individual circumstances.
Security:
Cport.Com actively and automatically monitors all of our systems for attempts at breaching
our security, or attempts to access systems or resources that are not available for
customers to use or access. This is commonly known as "hacking". Any attempt to
access or modify unauthorized computer system information or to interfere with normal
system operations, whether on the equipment of Cport.Com or of any computer system or
network that is accessed by our services, will result in immediate and permanent
cancellation of your account and may also lead to other legal proceedings against you.
ANYONE FOUND ACCESSING OR ATTEMPTING TO ACCESS UNAUTHORIZED Cport.Com OR Cport.Com CUSTOMER EQUIPMENT WILL HAVE THEIR ACCOUNT IMMEDIATELY TERMINATED AND THE INCIDENT REPORTED TO THE WASHINGTON BUREAU OF THE FBI.
Examples of actions that will trigger security alarms at Cport.Com's network operations center are, but are not limited to:
Satan or port scans
Ping scans and Ping Floods
SNMP attempts
Mail host relay use or hi-jacking
Telnet, FTP, Rcommands, etc. to internal systems
Attempts to access privileged or private TCP or UDP ports
HTTP access without the use of a Web browser
Multiple and frequent Finger attempts
Excessive resource utilization
Source route spoofing
Smurf attacks
IP number spoofing or masquerading
Syn Floods
OOB attacks (WinNuke)
Password cracking or guessing schemes
Excessive e-mail postings (SPAM)
Cport.Com records the complete session of security breach attempts such as those mentioned above, and may forward this information on to the authorities during our investigations. Cport.Com takes security very seriously; this way you and all of our customers can enjoy a safe and productive Internet environment.
NONE OF THE ABOVE-MENTIONED SECURITY PROBLEMS ARE EVER ACCIDENTAL, AND NORMAL USE OF INTERNET SOFTWARE SUCH AS BROWSERS AND EMAIL PROGRAMS WILL NEVER CAUSE A PROBLEM. ALL OF THE ABOVE ACTIONS ARE DELIBERATE AND INTENTIONAL AND IN MANY CASES REQUIRE SOPHISTICATED PROGRAMS AND KNOWLEDGE.
Unlawful Usage:
Cport.Com's network of information services may only be used for lawful purposes.
Transmission of any material in violation of any federal or state regulation is
prohibited. This includes copyrighted material, material judged to be threatening or
obscene or material protected by trade secret.
Privacy:
While every attempt is made to keep all information passing to and from our systems, and
to and from our customers private, you must assume that any
information that you transmit or receive may not be private. Cport.Com does not
monitor or record normal usage of our systems. However, Cport.Com will fully cooperate
with any authority in investigation of illegal activity and may turn over logs and records
upon receipt of proper orders. The Electronic Communications Act of 1986 and the
Telecommunications Act of 1998 contains important privacy and confidentiality information.
Selling of Customer information:
Cport.Com does not and will
not sell or transfer any information about our customer base to any third party
for the purpose of using that information for marketing or direct sales.
Customer Connected Networks:
Customers who are connected to Cport.Com through digital connections directly attached to
their network (direct connect customers) are asked to make appropriate policy for the
users of your network. In all cases, Cport.Com reserves the right to disconnect any
customer connection that is using excessive resources of the Cport.Com network.
Cport.Com's security and abuse department will work with all customers to help ensure that
proper procedures are employed that limit the possibility of resource abuse.
